TERMS OF SERVICE

These Terms of Service govern your use of onceuponusstudios.myshopify.com and any purchase you make from Ridge Fierstos, doing business as Once Upon Us ("we," "us," "our").

1. WHO CAN ORDER

You must be 18 years of age or older to place an order. By ordering you confirm that you are 18 or older and that you have the legal capacity to enter into this agreement.

2. WHAT WE SELL

We create personalized artwork from photographs you supply, print it, and ship it to you along with a scannable code that links to a short video we generate for you.

Your artwork and video are generated using artificial intelligence. They are stylized creations, not photographs. Your artwork will resemble you but will not be an exact reproduction of any photo you send us. You accept this before ordering.

3. PHOTOS YOU SUBMIT

Orders must be of yourself. You may not order artwork of any other person.

By uploading photos you confirm that:
- Every photo is a photo of you
- You are 18 or older
- You own the photos or have the right to use them
- The photos do not contain anyone else, and do not contain anyone under 18
- The photos do not infringe anyone's rights

You grant us permission to process your photos to create your order, including processing by third-party artificial intelligence providers. See our Privacy Policy for how your photos are handled and deleted.

We may refuse or cancel any order where the photos do not meet these requirements, appear to be of someone else, or are unusable. If we cancel for unusable photos before production, we will refund you in full.

4. PROHIBITED USES

You may not use our service to create artwork that:
- Depicts anyone other than yourself

- Depicts a public figure, celebrity, or any identifiable third party
- Uses the trademarks, characters, logos, or protected designs of any film, television, sports, music, or other brand
- Is sexually explicit, hateful, harassing, defamatory, or unlawful
- Is intended to deceive anyone about who you are or what you have done

We may cancel any order that breaches this section, and we may refuse future orders. Orders cancelled for a breach of this section are not refunded if production has begun.

5. ORDERING AND PRODUCTION

After checkout we email you a link to upload your photos. Production begins when we receive them. Turnaround is approximately 14 days from receipt of your photos, plus shipping time. These are estimates, not guarantees.

We cannot start your order until you upload your photos. If we do not receive photos within 14 days of your order, we may cancel it. A refund will be issued if this is the case.

6. PRICES AND PAYMENT

Prices are in US dollars and are shown on the product page. We may change prices at any time, but changes do not affect orders already placed. Applicable taxes and shipping are calculated at checkout.

7. SHIPPING

See our Shipping Policy. Risk of loss passes to you on delivery. You are responsible for providing an accurate shipping address; we are not responsible for orders sent to an address you entered incorrectly.

8. REFUNDS

See our Refund and Return Policy. In short: all sales are final once production begins, and we will reprint or refund orders that arrive damaged, never arrive, or are wrong.

9. YOUR VIDEO AND SCAN CODE

Your video is hosted at a web address linked to the code printed on your product. Anyone holding your print, or the link, can view it. It is not password protected. Treat the link as shareable.

We host your video with no additional fee and nothing to renew. We may move, migrate, or change how videos are hosted. We will make reasonable efforts to keep your code working, but we do not guarantee indefinite availability, and we may remove content that breaches these terms. We also email you the video file so you always have your own copy.

10. OWNERSHIP

You own the photos you send us and you own the finished artwork and video we create for you. You may use them however you like, including printing, posting, and sharing.

We retain ownership of our brand, our website, our sample images, and our own marketing materials.

We will not use your photos, artwork, or video in our marketing, on our website, or on social media without your separate written permission.

11. ARTIFICIAL INTELLIGENCE DISCLAIMER

Artificial intelligence output is unpredictable. We cannot guarantee any specific result, likeness, level of accuracy, or artistic quality. We will use reasonable skill in producing your order, but the subjective quality of AI-generated artwork is not a basis for a refund. You accept this before ordering.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, our total liability to you for any claim relating to your order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including lost profits or emotional distress.

Nothing in these terms limits liability that cannot be limited by law.

13. INDEMNITY

You agree to indemnify us against any claim arising from photos you submit, including claims that the photos infringe someone's rights or that you did not have the right to submit them.

14. PRIVACY

Our Privacy Policy explains what we collect and how we use it, and forms part of these terms.

15. CHANGES TO THESE TERMS

We may update these terms. The date at the top shows when they last changed. The terms in effect when you place your order are the ones that apply to that order.

16. GOVERNING LAW

These terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law rules.
